These Terms of Service (“Terms”) govern your access to and use of the website located at www.arcschon.com and any associated applications, products or services (collectively, the “Services”) provided by Arcschon Haus LLC, doing business as Arcschon Aesthetics, Arcschön, and Arcschön Haus (“Arcschon Aesthetics,” “we,” “us,” or “our”). By accessing the Services or by clicking to accept or agree to the Terms when this option is made available to you, you agree to be bound by these Terms and our Privacy Policy and Payment Policy, which are incorporated herein by reference. If you do not agree to these Terms, do not access or use the Services.

Arcschon Aesthetics is an Arizona limited liability company with a principal mailing address at 7316 East Stetson Drive, Studio 14, Scottsdale, Arizona 85251.
Our Services include an informational website, online scheduling tools, telehealth consultation platforms, electronic medical records, marketing materials, membership programs and in‑person elective aesthetic treatments.

2. Agreement to Legal Terms & Modifications
These Terms constitute a legally binding agreement between you and Arcschon Aesthetics. By accessing the Services, you represent that you are at least 18 years of age or, if you are between 13 and 17 years old, that you have the consent of a parent or legal guardian to use the Services and receive treatments. You also represent that you have the authority to accept these Terms on behalf of yourself or any entity you represent.
We may amend these Terms at any time in our sole discretion. We will post updated Terms on our website with a new “Last Updated” date, and the updated Terms will be effective immediately upon posting. You are responsible for reviewing the Terms periodically. By continuing to use the Services after changes are posted, you agree to the revised Terms. If you do not agree to the revised Terms, you must discontinue your use of the Services.
3. Description of Services
Arcschon Aesthetics provides elective, non‑surgical cosmetic and wellness treatments to enhance your appearance and well‑being. Our offerings include laser hair removal, skin resurfacing, microneedling, chemical peels, neuromodulator injections (e.g., Botox), dermal fillers, intravenous hydration and vitamin drips, microneedling with platelet‑rich plasma, and other services permitted by law for licensed aestheticians, registered nurses and nurse practitioners. The Services also include access to informational content about cosmetic procedures, access to online scheduling and telehealth intake, membership programs, gift cards, sale of retail skincare products and communications via email, SMS and social media platforms.
The Services are intended for your personal, non‑commercial use. You may not use the Services to provide aesthetic treatments to others without our prior written consent, and you may not reproduce, duplicate, copy, sell, resell or exploit any portion of the Services without express permission.
3.1 Medical Oversight and LicensingAll clinical and aesthetic services offered by Arcschon Aesthetics are supervised by a licensed nurse practitioner. Treatments are performed only by licensed professionals acting within the scope of their licenses and under appropriate supervision and delegation in accordance with Arizona law. Arcschon Aesthetics does not practice medicine independently. We do not employ a physician and do not present ourselves as physicians. Certain treatments are prescription‑based and require a Good Faith Exam conducted by a licensed physician, nurse practitioner or physician assistant to determine if the treatment is safe and appropriate for you. Good Faith Exams may be performed in person at our clinic or via a HIPAA‑compliant telehealth platform. You agree to cooperate in completing all required medical intake forms, providing accurate health history and attending a Good Faith Exam when required. We reserve the right to decline or postpone services based on medical history, contraindications, provider discretion or failure to submit necessary documentation.
3.2 Telehealth Evaluation and Treatment ClearanceWe utilize third‑party telehealth platforms such as SpaKinect and Qualiphy to conduct Good Faith Exams. By booking or receiving treatment from Arcschon Aesthetics, you consent to telehealth evaluation and agree that your eligibility for services may be determined virtually at the sole discretion of the evaluating provider. Telehealth evaluations are part of our commitment to patient safety and compliance with applicable state regulations. You acknowledge that telehealth may involve electronic transmission of medical information and consent to the risks associated with remote evaluations. We are not responsible for delays, interruptions or technical difficulties that may arise during telehealth sessions.
3.3 HIPAA Compliance and Third‑party SystemsWe take the privacy and security of your protected health information (PHI) seriously. Arcschon Aesthetics complies with the Health Insurance Portability and Accountability Act of 1996 (HIPAA) and similar state laws to safeguard your PHI. We use secure, encrypted platforms to manage scheduling, clinical charting and communications. Our primary electronic medical record and point‑of‑sale system is Boulevard. For telehealth consultations and Good Faith Exams we use SpaKinect and Qualiphy. Additional third‑party vendors may provide services such as email marketing (Mailchimp), social media management (Meta Business Suite), analytics (Microsoft Clarity), electronic signatures (DocuSign) and customer messaging (ManyChat, Tidio). We only share your PHI with vendors that are contractually obligated to protect it and that provide HIPAA‑compliant services. 3.4 Client‑Supplied ProductsOccasionally clients may wish to provide their own products—including injectable medications, dermal fillers, IV solutions or topical skincare—for use during a service. By supplying a product, you represent and warrant that it has been obtained from a legitimate manufacturer or distributor, has been stored properly and is within its expiration date. Arcschon Aesthetics does not test, endorse or guarantee the safety, quality or efficacy of client‑supplied products. We reserve the right to refuse the use of any product provided by a client, and we will not be liable for any injury, adverse reaction or complication arising from the use of client‑supplied products. You assume all risks associated with using products that you supply.
3.5 Information Not Intended as Medical AdviceInformation provided on our website, in social media posts, blog articles or during consultations is for general educational purposes only and is not medical advice. Individual results vary widely, and aesthetic treatments carry inherent risks. While our team strives to provide accurate information, we do not guarantee that any information provided will be error‑free or applicable to your circumstances. Arcschon Aesthetics does not assume or provide ongoing medical care, and we do not replace your relationship with a primary care physician or other healthcare provider. Always seek the advice of a qualified healthcare professional regarding any medical condition or treatment. If you experience a medical emergency, call 911 or visit the nearest emergency department immediately.
4. Eligibility and Treatment Requirements
4.1 Age and Residency RequirementsYou must be at least 18 years of age to receive treatment or use the Services, except that minors aged 13–17 may receive certain treatments (for example, laser hair removal) only with the express written consent of a parent or legal guardian and subject to approval by our supervising nurse practitioner. We may require documentation to verify age, identity and guardianship.
Our Services are intended for users located within the United States. If you access the Services from outside the United States, you do so on your own initiative and are responsible for compliance with local laws. By continuing to use the Services, you consent to the transfer and processing of your data in the United States and acknowledge that U.S. laws may differ from those in your jurisdiction.
4.2 Medical Intake and Good Faith ExamsBefore receiving any treatment, you must complete our medical intake forms honestly and in full, disclosing all medical history, medications, allergies and relevant health information. Failure to disclose accurate information may result in service refusal, complications or forfeiture of fees. As required by Arizona law, all new patients seeking prescription‑based services must undergo a Good Faith Exam conducted by a licensed provider. A Good Faith Exam includes a review of your medical history, an assessment of your suitability for treatment and documentation of the evaluation. Good Faith Exams may be valid for a limited period and may need to be repeated before subsequent treatments. If your health status changes or your Good Faith Exam expires, you must complete a new evaluation before further services.
4.3 Right to Decline or Discontinue ServicesArcschon Aesthetics reserves the right, in its sole discretion, to decline or discontinue services to any client for any reason permitted by law, including but not limited to contraindications, safety concerns, disruptive behavior, harassment of staff, failure to comply with treatment instructions or non‑payment. We may also postpone or cancel services if our supervising nurse practitioner determines that a treatment is not medically appropriate. We will make reasonable efforts to explain our decision but are under no obligation to provide treatments that we deem unsafe or inappropriate.
5. Ownership of Content & Intellectual Property
5.1 Our Intellectual Property RightsArcschon Aesthetics owns or licenses all intellectual property rights in the Services, including without limitation the site design, text, graphics, logos, images, audio clips, digital downloads, data compilations, software and the compilation thereof (collectively, the “Content”). The names, logos and slogans displayed on the Services are our trademarks and service marks (the “Marks”). The Content and Marks are protected by U.S. and international copyright, trademark and other intellectual‑property laws. We grant you a limited, non‑exclusive, non‑transferable, revocable license to access and use the Services for your personal, non‑commercial use. Except as expressly allowed in these Terms, you may not copy, reproduce, distribute, transmit, display, perform, publish, license, modify, create derivative works from or exploit any part of the Services without our prior written consent.
5.2 Use of MaterialsYou may download or print copies of public portions of the Services for your own personal, non‑commercial use, provided that you do not modify the Content and that all copyright and proprietary notices remain intact. If we grant you permission to post, reproduce or display any part of our Content, you must identify Arcschon Aesthetics as the source and ensure that any copyright or proprietary notice appears on the reproduced materials. We reserve all rights not expressly granted to you in and to the Services, the Content and the Marks.
5.3 Third‑party Content and LinksThe Services may contain links to third‑party websites, products or services that are not owned or controlled by Arcschon Aesthetics. Links to third‑party sites are provided for convenience only and do not constitute endorsement of the third party or any product or service offered. We have no control over, and assume no responsibility for, the content, privacy policies or practices of any third‑party websites. You acknowledge and agree that we shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with your use of or reliance on any such content, goods or services available on or through third‑party websites.
6. User Responsibilities & Prohibited Activities
By accessing the Services, you agree to comply with these obligations:
Provide Accurate Information: You will provide true, complete and current information about yourself during intake, consultations and communications. You will promptly update your information if it changes.
Maintain Confidentiality: If you are issued a username, password or other credential, you will keep it confidential and not share it with any other person. You are responsible for all activities that occur under your credentials.
Respect Intellectual Property: You will not copy, reproduce, modify, distribute, perform or publicly display any part of the Services except as expressly permitted. You will not remove or alter any copyright or proprietary notices.
Lawful Use: You will use the Services only for lawful purposes and will not engage in any activity that violates any law, regulation or ordinance or infringes the rights of any third party. This includes refraining from posting, transmitting or sharing any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, obscene or otherwise objectionable.
Prohibited Conduct: Without limiting the foregoing, you agree not to:
Access or attempt to access any data, system, or server without authorization;
Introduce viruses, worms, Trojan horses, spyware or other malicious code to the Services;
Reverse‑engineer, decompile, disassemble or otherwise attempt to discover the source code of the Services or any part thereof;
Use any automated means to scrape, crawl or extract data from the Services;
Impersonate any person or entity or misrepresent your affiliation with any person or entity;
Upload or transmit unsolicited or unauthorized advertising, promotional materials, spam or junk mail;
Harass, abuse or harm another person or entity; or
Interfere with or disrupt the Services or any networks connected to the Services.
We reserve the right to investigate and take appropriate legal action against any user who violates these obligations or engages in conduct that we deem inappropriate. We may suspend or terminate your access to the Services and cooperate with law‑enforcement authorities in prosecuting violators.
7. Payment, Billing & Financial Terms
7.1 Fees and Acceptance of PaymentYou agree to pay all fees and charges incurred in connection with your purchase of products or services according to the prices in effect when the charges are incurred. Prices for services may vary depending on the type of treatment, number of units or amount of product used and any special offers or membership discounts. All prices are subject to change without notice. Applicable taxes, fees and surcharges may be added to your order at checkout.
We accept the following forms of payment:
Cash: Payments made by cash in full at the time of service qualify for a cash discount as described in our Payment Policy.
Credit and Debit Cards: We accept Visa, Mastercard, American Express and Discover. A card‑processing fee of 3 % is added to card transactions to cover third‑party processing costs. Arcschon Aesthetics absorbs the remainder of the card processor’s fees. By providing payment information, you authorize us to charge your card for all purchases you make.
Zelle: We accept Zelle transfers; please ask for our routing information at your appointment. Zelle payments do not qualify for the cash discount.
Cherry Financing: For qualified clients, we offer payment plans through Cherry Technologies, Inc. Financing is subject to Cherry’s approval criteria, terms and interest rates. By applying for financing, you agree to comply with Cherry’s terms of service.
7.2 Deposits and CancellationsCertain appointments, such as lengthy procedures or appointments during high‑demand times, may require a deposit to secure your time with our providers. Deposits are applied toward your balance due at the time of service. If you cancel or reschedule your appointment with less than 24 hours’ notice or fail to appear for your appointment, your deposit may be forfeited. See our Cancellation & No‑Show Policy for details on notice requirements and potential fees.
7.3 No Insurance Billing and Final SalesElective cosmetic and wellness services are typically not covered by health insurance. Arcschon Aesthetics does not participate in any insurance or third‑party payor programs and will not file claims on your behalf. All sales of services, treatments, packages, memberships and gift cards are final and non‑refundable. We cannot guarantee outcomes or results, and we do not offer refunds for services rendered. In cases where you prepay for services, packages or memberships, unused credits may expire if not used within the time stated at purchase; please review your package or membership agreement for details.
8. Cancellation & No‑show Policy
8.1 Client-Initiated CancellationsWe value our providers’ time and strive to accommodate as many clients as possible. Appointments canceled or rescheduled with less than 24 hours’ notice may be subject to a cancellation fee. Clients who fail to show up for an appointment without prior notice may forfeit deposits, pre‑payments, or service credits and may be required to prepay for future appointments. Repeated no‑shows or late cancellations may result in denial of service or termination of membership benefits. We will provide notice of any changes to our cancellation policy on our website.
8.2 Provider-Initiated CancellationsArcschön Aesthetics, including its owners, affiliates, employees, independent contractors, and authorized providers (collectively, “Arcschön”), reserves the unrestricted right, at any time and for any reason, to cancel, postpone, or reschedule any appointment, procedure, or service, in its sole and absolute discretion. This right may be exercised without prior notice and includes, but is not limited to, circumstances involving provider illness or emergency, scheduling or staffing conflicts, equipment malfunction, facility or safety issues, or any situation in which continuing care with a client is, in Arcschön’s judgment, inappropriate, impractical, unsafe, or inconsistent with its policies, values, standards of care, or professional ethics as referenced throughout these Terms.
In the event an appointment is canceled, postponed, or rescheduled by Arcschön, reasonable, good-faith efforts will be made to notify the client and offer an alternative appointment time. Where a deposit or prepayment has been made, such funds shall remain credited to the client’s account and may be applied toward a future booking in accordance with the Payment, Billing & Financial Terms set forth in Section 7, unless otherwise required by applicable law.
If an appointment is canceled by Arcschön as a result of a client’s verbal, nonverbal, or physical conduct, language, or behavior that, in Arcschön’s sole determination, constitutes harassment, abuse, intimidation, or disruption, creates or contributes to an unsafe, hostile, or unprofessional environment, or otherwise breaches any provision of these Terms, including the Client Conduct and Eligibility requirements described in Section 4, any associated deposit, prepayment, or account credit shall be deemed forfeited. Arcschön further reserves the right to refuse, suspend, or permanently discontinue services to such client and to deny future appointments at its discretion. These actions may be taken at any time, without prior notice, and shall be deemed final at Arcschön’s sole discretion.
To the fullest extent permitted by law and consistent with the Limitation of Liability set forth in Section 14, Arcschön Aesthetics shall not be liable for any actual, incidental, indirect, consequential, or punitive damages, losses, or expenses arising from or relating to provider-initiated cancellations, postponements, or rescheduling, regardless of cause or notice provided.
9. Membership Terms
We may offer optional membership programs that provide clients with recurring services, discounted pricing or other benefits in exchange for a periodic fee. Memberships are non‑transferable and subject to the billing terms and specific benefits outlined at the time of enrollment. Membership fees are charged on a regular schedule (e.g., monthly) using the payment method on file. Membership benefits may include priority booking, discounted treatments, complimentary services or product credits. Unused membership services or credits may expire at the end of each membership period unless otherwise specified. Abuse of membership privileges, failure to comply with clinic policies or repeated late cancellations may result in suspension or termination of membership at our discretion. We reserve the right to update, modify or discontinue membership benefits with at least 30 days’ written notice to active members.
10. Affiliate Relationships & Product Links
Arcschon Aesthetics may include links to professional‑grade skincare lines, supplements or other wellness products on our website or in our communications. We may receive a commission or promotional consideration when you purchase these products through our links. All affiliate links will be identified in accordance with Federal Trade Commission (FTC) regulations. You are not obligated to purchase products through our affiliate links, and you will not pay a higher price for doing so. We only promote products that align with our treatment philosophy and clinical standards; however, we make no warranty as to the efficacy of any third‑party product or service.
11. Communications & Marketing
11.1 Email and Phone CommunicationsBy providing your contact information, you consent to receive communications from us via email, text message (SMS) and phone calls regarding appointments, treatment reminders, promotions and general business updates. Message and data rates may apply depending on your carrier and plan. You can opt out of marketing emails by clicking the unsubscribe link in our emails. To stop receiving promotional texts, reply STOP to the text message. Even if you opt out of marketing communications, we may still send transactional messages related to your appointments, account or treatment instructions.
11.2 User Content and TestimonialsIf you voluntarily submit reviews, testimonials, before‑and‑after photographs or other user‑generated content to Arcschon Aesthetics, you grant us a non‑exclusive, royalty‑free, perpetual and worldwide license to reproduce, distribute, publish and otherwise use such content in marketing, advertising or other materials. You represent and warrant that any user‑generated content you submit does not infringe the rights of any third party and that you have obtained all necessary permissions to grant us the above license. We will not use your name, likeness or images without your written consent. You may revoke your consent for us to use your testimonials or images at any time by contacting us in writing.
12. Digital Analytics & Tracking
We use analytics tools such as Microsoft Clarity and similar services to collect anonymized information about how users navigate our website, including mouse clicks, scrolling, and navigation patterns. These tools help us improve the functionality and usability of our site. The information collected is aggregated and does not include personally identifiable information or PHI. 13. Disclaimer of Warranties
The Services, including all information, content and materials available through our website, are provided “as is” and “as available” without warranties of any kind, express or implied. Arcschon Aesthetics disclaims all warranties, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, title and non‑infringement. While we strive to provide accurate and current information, we make no representation or warranty that the Services will meet your requirements, be uninterrupted, timely, secure or error‑free. We do not guarantee any particular outcome, result or success from any treatment, product or service; individual results will vary, and elective procedures carry inherent risks and potential side effects. You assume full responsibility for evaluating the accuracy and completeness of all information made available through the Services and for any decisions or actions you take based on that information.
14. Limitation of Liability
To the fullest extent permitted by applicable law, Arcschon Aesthetics, its owners, affiliates, employees, contractors and agents shall not be liable for any indirect, incidental, special, consequential or punitive damages (including but not limited to lost profits, lost revenue, lost data or diminished enjoyment) arising out of or related to your use of the Services, even if we have been advised of the possibility of such damages. Our total liability to you for any and all claims arising from or related to the Services shall not exceed the greater of (a) the amount you paid, if any, for the Services in the six months preceding the claim or (b) US $500. Some jurisdictions do not allow the exclusion or limitation of certain damages; therefore, the above limitation may not apply to you. In such cases our liability will be limited to the maximum extent permitted by law.
15. Indemnification
You agree to indemnify, defend and hold harmless Arcschon Aesthetics, its officers, directors, employees, contractors, agents, affiliates, successors and assigns from and against all claims, liabilities, damages, losses, costs, judgments, awards and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your violation of these Terms or any law or regulation; (b) your use of the Services; (c) your submission of any user‑generated content; (d) your use of products you provide or your misuse of any product or treatment; or (e) your violation of the rights of any third party. We reserve the right to assume exclusive control of the defense of any matter subject to indemnification, and you agree to cooperate with us in such defense.
16. Governing Law & Dispute Resolution
These Terms and your use of the Services are governed by the laws of the State of Arizona, without regard to its conflict‑of‑laws principles. The United Nations Convention on Contracts for the International Sale of Goods and the Uniform Computer Information Transaction Act do not apply to these Terms.
16.1 Informal Negotiation and Notice RequirementIf you have a dispute with us relating to the Services or these Terms, you agree to contact us in writing and attempt to resolve the dispute informally by providing a description of your claim and the relief you seek. Both parties agree to negotiate in good faith for at least 30 days after the dispute notice is received. If the parties are unable to resolve the dispute informally within 30 days, either party may initiate arbitration as described below.
16.2 Binding ArbitrationAny dispute, controversy or claim arising out of or relating to these Terms, the Services, or the breach thereof (a “Dispute”)—except those disputes expressly excluded below—shall be resolved by binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules and, if applicable, its Supplementary Procedures for Consumer‑Related Disputes. Arbitration shall be conducted by a single arbitrator chosen in accordance with the AAA Rules. The arbitration may be conducted in person, through the submission of documents, by phone or online. The arbitration shall take place in Maricopa County, Arizona, unless the AAA Rules or the arbitrator determine another location is more appropriate. Each party shall bear its own costs and attorney’s fees, unless the arbitrator awards fees pursuant to applicable law. The arbitrator’s decision shall be final and binding, and judgment upon the award rendered may be entered in any court having jurisdiction thereof. By agreeing to arbitration, you waive your right to a jury trial.
16.3 Exceptions to ArbitrationThe following disputes are not subject to the above requirement for binding arbitration: (a) any claims seeking to enforce or protect intellectual‑property rights; (b) disputes related to allegations of theft, piracy, invasion of privacy or unauthorized use of the Services; and (c) any claim for injunctive relief. If this arbitration clause is found to be unenforceable, then the Dispute shall be brought in the state or federal courts located in Maricopa County, Arizona, and the parties consent to the personal jurisdiction of such courts and waive any objections based on inconvenient forum.
16.4 Class‑action WaiverThe parties agree that any arbitration or court proceeding shall be limited to the Dispute between the parties individually. To the fullest extent permitted by law, no arbitration or proceeding shall be joined with any other; there is no right or authority for any Dispute to be arbitrated or litigated on a class‑action basis or to use class‑action procedures; and there is no right or authority for any Dispute to be brought in a purported representative capacity on behalf of the general public or other persons.
16.5 Time Limit to Bring ClaimsYou agree that any Dispute must be filed within one (1) year after the cause of action arises; otherwise, the claim is permanently barred. This limitation applies regardless of any statute or law to the contrary.
17. Miscellaneous Provisions
17.1 Entire AgreementThese Terms, together with any policies or operating rules posted on the Services or provided to you in connection with the Services (such as our Privacy Policy, Payment Policy and Cancellation & No‑Show Policy), constitute the entire agreement between you and Arcschon Aesthetics regarding the Services and supersede all prior or contemporaneous written or oral agreements.
17.2 SeverabilityIf any provision of these Terms is held by a court or arbitrator to be invalid, illegal or unenforceable, the remaining provisions shall remain in full force and effect. The invalid, illegal or unenforceable provision shall be replaced with a valid provision that most closely reflects the parties’ original intent.
17.3 AssignmentArcschon Aesthetics may assign any of its rights and obligations under these Terms without notice to you. You may not assign or transfer any of your rights or obligations without our prior written consent. These Terms shall inure to the benefit of and be binding upon each of our successors and assigns.
17.4 WaiverNo waiver by Arcschon Aesthetics of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition. Any failure to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
17.5 InterpretationThe headings and section titles used in these Terms are for convenience only and shall not affect the interpretation of the provisions. When the context requires, the singular includes the plural and vice versa, and “including” means “including without limitation.”
17.6 Force MajeureWe will not be liable for any delay or failure in performance resulting from acts beyond our reasonable control, such as acts of God; natural disasters; terrorism; war; cyberattacks; epidemics; governmental action; labor conditions; and power, internet or telecommunications failures.
